Is CBD Legal in Texas? What Olsiva Customers Need to Know

Is CBD Legal in Texas? What Olsiva Customers Need to Know

Short answer: yes, hemp-derived CBD is legal in Texas — but "legal" and "any product ships here" aren't quite the same question, and a few rules have changed recently. Here's where things actually stand.

The state law, in plain terms

Texas legalized hemp-derived CBD back in 2019 under House Bill 1325, following the federal 2018 Farm Bill's definition of hemp as cannabis with no more than 0.3% delta-9 THC by dry weight. Oils, tinctures, gummies, capsules, and topicals that meet that threshold remain legal to buy and possess in Texas today.

Two things have changed more recently that are worth knowing about. As of an October 2025 executive order, Texas now requires buyers to be 21 or older to purchase CBD products — which is why you'll see an age check on our site before you can shop. And a 2025 state law made it a Class A misdemeanor to sell vape or e-cigarette products containing any cannabinoids, CBD included. That one doesn't affect Olsiva's lineup — we don't sell inhalables — but it's part of why Texas's rules get confused with the separate, ongoing legal fight over smokable hemp and THC-A products, which is a different category entirely and not something we carry.

What this means for ordering from Olsiva

Being legal in Texas and being available for us to ship to Texas are two different checks, because shipping rules depend on the specific product's formulation, not just state law. Olsiva's THC-free tinctures, gummies, softgels, and pet products ship to Texas without restriction. The one exception in our current lineup is the Muscle & Joint Gel, which is a full-spectrum topical carrying trace, federally compliant THC rather than zero — that one product does not currently ship to Texas addresses, regardless of the state law allowing hemp-derived CBD generally.

If you're ordering and you're not sure which category a product falls into, check the product page or the batch's Certificate of Analysis for a THC-free confirmation before you check out.

One more thing on the horizon

A federal law signed in November 2025 (H.R. 5371) redefines hemp and caps total THC per container starting November 12, 2026. It's aimed mainly at the intoxicating hemp products at the center of Texas's ongoing court fight, and CBD isolates and THC-free formulations are expected to remain unaffected. We're tracking it and will update this page if anything changes for our lineup.

The bottom line for Texas customers

Hemp-derived CBD under 0.3% THC is legal to buy and possess in Texas, you need to be 21 or older to purchase, and the specific product's formulation — not just the category — determines whether we can ship it to your address.
