Is CBD Legal in Tennessee? Shipping & Legal Status Explained

Is CBD Legal in Tennessee? Shipping & Legal Status Explained

Here's the plain answer, because Tennessee's rules changed recently and a lot of what's online is now out of date: hemp-derived CBD is legal to buy and possess in Tennessee, but as of this year, we can no longer ship any CBD product to a Tennessee address. That's not a maybe — it's current state law, and we want to be upfront about it rather than let you add something to your cart that we can't actually send you.

What changed

Tennessee's House Bill 1376, effective January 1, 2026, prohibits shipping or delivering hemp-derived cannabinoid products directly to Tennessee consumers. Under the new framework, these products can only be sold face-to-face at licensed retail locations that restrict entry to customers 21 and older — grocery stores, convenience stores, and general retailers are no longer permitted to sell them either, and neither is any online seller shipping into the state.

This isn't about THC content

This is the part worth being clear about: it doesn't matter whether a product is full-spectrum or completely THC-free. Tennessee's shipping ban applies to hemp-derived cannabinoid products as a category, not based on THC percentage. So while our THC-free tinctures, gummies, and softgels ship without restriction almost everywhere else in the country, Tennessee is the one state where none of Olsiva's catalog can currently be shipped, regardless of formulation.

What this means if you're in Tennessee

CBD itself remains legal for you to purchase and possess — the law didn't ban the product, it banned direct-to-consumer shipping of it. In practice, that means picking it up from a licensed in-state retailer is your legal path right now; ordering online from a seller like Olsiva isn't something the law currently allows for a Tennessee delivery address. We'd rather tell you that plainly upfront than have an order get blocked at checkout.

Keep this in mind if things change

State-level hemp and cannabinoid law has been moving quickly across the country this year, and Tennessee is a good example of how fast a shipping rule can shift. If you're in Tennessee, it's worth checking back — we'll update this page if the shipping restriction changes. In the meantime, our CBD Education Guide has more on how state-by-state hemp rules generally work, including the THC-free vs. full-spectrum distinction that matters in most other states.
